The Zoning Board of Adjustment (ZBOA) and Appeals consists of 5 residents and 2 alternate members who reside within the corporate City limits of the City of San Marcos. Board members are appointed by the City Council and serve a maximum of two 3-year terms which expire in February.
Responsibilities
The purpose of this board is the consider variances and special exceptions to the standards established in the Zoning Ordinances.
The ZBOA is the:
- Final decision maker on the following applications: a special exception, and a change in the status of a nonconformity
- Final decision maker for appeals regarding the following development applications: A Certificate of Appropriateness, A denial based on the provision of Chapter 4 and/or Chapter 6 (except for provisions related to plats) of the Land Development Code, A certificate of occupancy, an appeal of the Planning Director's decision on a sign permit or an interpretation of the sign regulations, and an appeal of official's decision
- Final decision maker on petitions for relief of the following: A variance to any requirement of Chapter 4 of the Land Development Code, and a sign variance
