Municipal Court

The San Marcos Municipal Court has received judicial approval of its reopening plan. This plan along with the Hays County Judiciary’s Plan is attached. The Hays County plan is attached as they control access and maintenance to the building. The court is currently conducting virtual hearings and limited in person appearances. Please note, vulnerable populations may contact the court for a variance consideration of their appearance. Jury trials have been delayed until 2021. If you are set for a jury trial during the months of September through December of 2020, your case will be rescheduled in accordance with direction from our Texas Appellate Courts. BEGINNING WEDNESDAY, JANUARY 13, 2020 AT 2:30 P.M. THE FOLLOWING LOCAL RULE FOR MUNICIPAL COURT APPLIES TO JURY TRIALS: 

The Municipal Court customer service counter will open to the public as directed by the City of San Marcos reopening plan; the opening date is Wednesday, September 16, 2020.  Municipal Court customer service hours are currently 8:30 A.M. to noon and 1:00 P.M. to 4:30 P.M. Monday through Friday. 



If you are assessed fines and court costs as a result of a citation and are unable to pay in full, bring this to the attention of the court, payment plans as well as alternative options for defendants who qualify are available to satisfy the courts orders.

The San Marcos Municipal Court Of Record is responsible for the adjudication of all Class "C" misdemeanor laws established by State Law and City Ordinance within the territorial limits of the City of San Marcos.

Operations include conducting bench trials, jury trials, pre-trials, arraignments, hearings for juveniles, show cause hearings, and conducting parking hearings. The court also issues arrest and search warrants, capias pro fines, subpoenas, summonses, and collects fines and fees.

Implements compliance initiatives for individuals who fail to appear for court dates or who fail to pay/satisfy a judgment ordered by the court. Those initiatives include deputy marshals for warrant enforcement which includes a cooperative program with the Department of Public Safety to deny driver license renewals.
