The City of San Marcos Downtown Master Plan identified a form-based code as a tool to aid in the implementation of the plan. The City of San Marcos is in the process of adopting the SmartCode. The SmartCode is a type of form-based code that has been modeled for San Marcos. The adoption of the SmartCode requires the rezoning of your property from the traditional commercial, residential, industrial or mixed use zoning designation to a transect designation such as T1,T2, T3, T3.5, T4, T4.5 or T5. Similar to the traditional zoning designations the transect designations have permitted and non-permitted uses and specific development standards unique to each designation. Proposed Land Development Code Revisions

The Land Development Code is being revised to: remove inconsistent and unclear language, promote an attractive visual environment, and improve clarity, conciseness, predictability and usability for residents, development professionals and the business community.   The draft revisions are available for  public review  and reflect the guidance that staff received in public workshops and technical review roundtable sessions.

Proposed Land Development Code Revisions


Homebuyer Incentive Programs

The City of San Marcos is actively promoting homeownership opportunities as a means of promoting local economic development and stimulating business and commercial activity in the City.  The City has established homebuyer incentive programs for this purpose as allowed by Chapter 380 of the Texas Local Government Code.

The City is offering homebuyer incentives to Seton Medical Center - Hays employees that have an annual income of at least $45,000 and to Texas State University - San Marcos Tenured, Tenure-track, and Research Professors.  

The incentives are provided in the form of a $5,000, zero-interest, forgivable loan.  The loan balance is reduced by 20% ($1,000) on each one-year anniversary of the closing date provided the homebuyer continues to occupy the home as the family’s principal residence and retains eligibility status through his/her employer.  At the close of the fifth year, providing the homebuyer has maintained eligibility, the entire balance will be “forgiven” and a Lien Release will be filed by the City. 

Eligible properties will be a single-family residence, which includes townhomes, patio homes, and condominiums, that is located within the city limits.  The home can be an existing structure or one that is newly constructed.

The process to apply for this incentive is simple:

  • Complete the “Residential Homebuyer Incentive Program" application form.
  • Obtain verification of eligibility from the Human Resourses/Personnel Department of your employer.
  • Select the lender of your choice for the primary mortgage.
  • Once the lender has given preliminary loan approval, obtain a Good Faith Estimate from the lender.
  • Submit your 2-page application, along with a copy of the Good Faith Estimate, to the City’s Development Services Department located on the second floor of the Municipal Building, 630 East Hopkins Street.

The incentives are available on a first-come, first-serve basis.  Completed applications that meet all eligibility requirements are scheduled in the order in which they are received for funding through the program. 

                Seton Medical Center - Hays

On October 20, 2009 the City Council approved an Agreement with Seton Medical Center - Hays to provide funding for ten Homebuyer Incentive Loans to full-time employees earning a minimum of $45,000 annually.  More information about the program and the application form are available at the following links:

Texas State University Professors

The City, in partnership with Texas State University, has approved an incentive program to encourage Texas State University Professors to purchase a home inside the City Limits.  The program is open to Tenured, Tenure-Track, and Research Professors who have not owned a residence in San Marcos within the past three years.

The initial funding amount that was approved by the City Council on February 3, 2009 is $50,000, providing funds for ten loans.   The funding for ten additional loans became available October 1, 2009 with the start of the new fiscal year.
